Dec 13, 2013: Defamation isn't protected by the First Amendment when it constitutes false and unprivileged statements of fact. So, no one has any special protection to defame someones character and claim First Amendment protection. There is a strong and venerable rule in American law against pretrial injunctions prohibiting defamation. It comes from two sources: equity and the First Amendment. In other words, it is unconstitutional to stop any writer from writing for fear they "might" write something false or defamatory. Much of the blogosphere seems to forget that sometime and resorts to negative vitriol instead of facts. Right now in Alabama there is a progressive blogger, Robert Shuler, who has been writing a blog called "Legal Schnauzer" for several years and has been arrested and jailed because of it. Though someone could make a case about him making "false and unprivileged statements of fact" on some issues regarding the character of some Alabama candidates and politicians, he was issued an injunction "prohibiting defamation." Shuler's politics is not something I agree with very much, but I do believe the pendulum which is swinging against the First Amendment is swinging against the Constitution on this case, and for that reason, his plight is worthy of support and needs to be watched.

![]() Jan 15, 2014: Last month I mentioned that there is a blogger in America was arrested and was siting in jail. He is still sitting in jail in Alabama. He was charged with a contempt charge in connection with a defamation lawsuit filed by the son of a former governor per a judges order that many legal representatives consider to be unconsitutional. The blogger, Roger Shuler (Legal Schnauzer) and his plight was the subject of an op-ed by Campbell Robinson in the New York Times this last weekend ("Blogger’s Incarceration Raises First Amendment Questions"). Shuler has a long history of agressive pursuit in exposing any issue of his interest. He has also made a lot of enemies. But, the ramifications of an unconstitutional attack on the First Amendment creates strange bedfellows. Robinson points out that "The National Bloggers Club, a group led by the Republican activist Ali Akbar, who has also threatened to sue Mr. Shuler for defamation, released a statement condemning Mr. Shuler’s “rumormonger cyberbullying” but also criticizing the injunction as creating a potential chilling effect on blogging." At issue is a potential libel problem by Shuler which has kind of put Shuler in kind of a love-hate relationship with most interested parties. (He has already suggested he will sue the judge after this is all over). “You’ve got a situation where sometimes there’s no good guys,” said Ken White, a former federal prosecutor in Los Angeles who writes about and practices First Amendment law......“Idiocy is not a zero-sum game,” Mr. White said. “I think you can say that what the court is doing is unconstitutional and troublesome and also that Shuler is his own worst enemy.”
